The purpose of Blanco Wellness's Privacy Policy ("Privacy Policy") is to inform you how Blanco Wellness (ABN 47 319 539 517) manages, collects, uses, processes and discloses your Personal Data, in accordance with the privacy principles set out in the Privacy Act 1988 (Cth) and the general law intended to protect your privacy, as amended from time to time, and with additional provisions for customers located in the European Economic Area, United Kingdom and California given we ship and sell internationally. Protecting our customers' Personal Data and compliance with Applicable Laws is of the utmost importance to Blanco Wellness and a matter we take very seriously. This Privacy Policy applies to all Personal Data we collect through our Platforms or other channels.

When you submit information to us, sign up as a customer on our Platforms, or otherwise purchase, view or browse any of the products, services or content we offer, you agree and consent to Blanco Wellness collecting, using, disclosing and sharing your Personal Data, and disclosing such Personal Data to our authorised service providers and relevant third parties, in the manner set out in this Privacy Policy.

Please read and review this Privacy Policy carefully. This Privacy Policy does not cover information collected from individuals as part of our recruitment and selection process, nor does it apply to the practices of organisations that Blanco Wellness does not own or control, even if links to their websites appear on our Platforms.

1. WHAT PERSONAL DATA DO WE COLLECT?

We may also collect information about you from third-party sources (including our payment processors and our e-commerce platform provider, Shopify) to supplement the information we collect directly from you.

This includes usage data such as browser type, referring pages, pages viewed and other diagnostic data, which we may combine for analytics and service optimisation purposes.

If you provide us with Personal Data relating to a third party (for example, a gift recipient's delivery address), you represent to us that you have obtained their consent to provide us with their Personal Data for the respective purpose.

By submitting your Personal Data to us when registering for an account, browsing our website, or ordering any of our products, you are agreeing to the terms of this Privacy Policy.

We do not intentionally collect Personal Data of children. If you believe a child has provided their Personal Data to us, please contact us so we can take steps to delete the information as soon as possible.

We do not directly collect your credit card details to process your payment. Your credit card details are collected, processed and stored directly by our third-party payment processor pursuant to their own terms of use and privacy policy. We may collect your bank account details to process refunds where a refund cannot be made to the original payment method.

3. HOW WILL YOUR PERSONAL DATA BE USED?

We may use and disclose your Personal Data for purposes necessary to provide you with our products and services, including to:

(a) provide, maintain and improve our website and services, and monitor their effectiveness;

(b) register and maintain your account and verify your identity;

(c) process your order and payment;

(d) deliver or perform the products or services you purchased, including couriers contacting you to obtain delivery instructions;

(e) process your returns or refunds;

(f) provide you with supporting services related to your account, such as saved items or notifications;

We may also disclose your Personal Data for secondary purposes if the secondary purpose is related to the Purpose or Additional Purpose and you would reasonably expect us to use or disclose the information for that secondary purpose, otherwise in accordance with Applicable Laws, or with your further consent.

You acknowledge and agree that, should we sell, merge or otherwise change control of our business to a third party, we shall be permitted to disclose the Personal Data we have collected from you to that third party, and to assign the benefit of any agreements we have with you to that third party.

We do not sell your Personal Data.

5. HOW CAN I ACCESS OR CORRECT MY PERSONAL DATA?

By submitting a written request to us via email at info@blancowellness.com, you may access or correct your Personal Data. We may need to request additional information from you to confirm your identity before providing access or making corrections.

We will do our best to respond to Personal Data access and correction requests within 30 days. Where we are unable to meet this timeline, we will update you with the soonest possible time within which we can provide the information or make the correction. Please note that certain types of Personal Data access and correction requests may be exempt under Applicable Laws, and we may charge a reasonable fee for handling and processing your access request, if permitted by Applicable Laws.

While we make reasonable efforts to provide users with access to their Personal Data, there may be circumstances in which we are unable to do so, including where the information is legally privileged, would compromise the privacy of other individuals, or where the request is clearly excessive or unfounded.

6. CANCELLING YOUR ACCOUNT

You may terminate your Blanco Wellness account at any time by emailing us at info@blancowellness.com. Once processing is complete, we will no longer collect, use or disclose your Personal Data in relation to your account, except to the extent we retain your Personal Data for fraud prevention, compliance, regulatory or other legal purposes.

7. HOW CAN YOU REQUEST DELETION OF YOUR PERSONAL DATA?

You have the right to request that we delete your Personal Data, or stop processing or collecting it, in some circumstances, for example in relation to receiving marketing communications or your account with Blanco Wellness. You should ensure that all Personal Data you submit to us is complete, accurate, up-to-date and correct. Failure to do so may result in our inability to provide you with the products and services you have requested. You should keep us updated of any relevant changes to your Personal Data. We will not be responsible for relying on inaccurate or incomplete Personal Data if you have not updated us of such changes.

Your Personal Data is important to us, and we design our systems with your security and privacy in mind. 9. PERSONAL DATA RETENTION, DESTRUCTION AND ANONYMISATION

When Personal Data in our possession is no longer required for the purpose it was originally collected, or retention is no longer necessary for any legal, compliance or business purpose, we will take reasonable measures to ensure such Personal Data is either destroyed or anonymised. If this is not possible (for example, where information is stored in backup archives), we will securely store your Personal Data and isolate it from further processing until deletion or anonymisation is possible.

10. DISCLOSURE OF YOUR PERSONAL DATA OVERSEAS

As we ship and sell globally, Blanco Wellness may transfer your Personal Data to recipients located outside the country where you live, including to Australia, where our business is based. If Personal Data is so transferred, we will comply with Applicable Laws in doing so, including taking reasonable steps to ensure the foreign recipient is bound to comply with standards of protection at least comparable to the Applicable Laws. California residents have the right to:

(a) know what personal information we collect and how it is used;

(b) request deletion of their personal information;

(c) correct inaccurate personal information; and

(d) not be discriminated against for exercising these rights.

We do not sell or share personal information as defined under the CCPA.

13. MARKETING MESSAGES

When you register with Blanco Wellness, we may send you promotional and direct marketing messages via various channels, including email and SMS, where you have not opted out of receiving such messages.

You can withdraw your consent, unsubscribe or opt out of marketing messages by using the unsubscribe facility in an email or SMS, or by contacting us directly (see "Contacting Us" below). Once we receive notification that you wish to withdraw consent, it may take up to five business days for this to be reflected in our systems; you may still receive messages during this period.

Regardless of whether you unsubscribe from marketing messages, you will still receive information we are required by law to provide, such as transactional or service-based communications relating to your account or orders.

We also use Meta (Facebook) Insights and Analytics to track engagement with our social media pages and understand audience behaviour across devices. Facebook's Privacy Policy is available on their website. If you want to opt out of seeing ads based on information we've shared with Facebook, you can manage this in your Facebook ad preferences.

You have the right to choose whether to accept our use of cookies and tracking technologies. You can disable cookies by adjusting your browser settings, though this may result in the loss of some website functionality.
